These Terms and Conditions (“Terms”) govern your use of the Save Mangroves Nursery website located at https://SaveMangroves.com (“Site”) and your (“Customer,” “Customer’s,” “you,” “your”) purchase of any products or services from Save Mangroves Nursery (“we,” “us,” or “our”). By accessing this Site or making a purchase, you agree to be legally bound by these Terms. If you do not agree, please discontinue use of the Site.

1. Company Overview

Save Mangroves Nursery is a family-run business committed to growing and delivering healthy Live Red Mangrove Plants for aquarium enthusiasts and coastal restoration advocates. We ship to all 50 U.S. states.

2. Eligibility to Use This Site

By using this Site, you represent that:

  • You are at least 18 years old or using the Site under the supervision of a parent or guardian

  • All information you provide is true, accurate, and current

  • You have the legal authority to place an order and agree to these Terms

3. Orders and Payment

When you place an order through our Site:

  • You agree that all information provided is accurate and complete

  • You authorize us to charge your selected payment method

  • Orders are subject to availability and confirmation

  • We reserve the right to refuse or cancel any order at our discretion

All prices are listed in USD. Payment processing is handled securely through trusted third-party providers.

4. Shipping and Delivery

We ship live mangrove plants to all 50 U.S. states.

  • Shipping Costs: Calculated at Cart and Checkout

  • Processing Time: Most orders are shipped within 2–3 business days but may extend up to 5 business days due to peaks in order volume

  • Delivery Time: Varies by location and carrier but typically within 5-7 business days of shipment date – not order date

  • Shipping Risks: Once the package is in transit, we are not responsible for delays or damages caused by carriers or incorrect addresses

5. Returns and Refunds

Due to the nature of live plants, we cannot accept returns once an order has been shipped. However, we strive to provide high-quality mangroves and excellent customer service. Keep in mind that these are extremely rare circumstances and less than 1% of plants arrive dead. The only time they do arrive dead are because customers do not pick them up in a timely manner upon delivery where the plants bake in the hot sun or freeze from the outside climate. DO NOT throw away plants you think are dead as we almost always have a solution to revive them.

If your plants arrive damaged or DOA (Dead on Arrival):

  • Contact us within 48 hours of delivery with clear images of the entire plant that are taken within 3 hours of delivery timestamp according to the tracking number that was provided to you.

  • Include photos of the damaged plant(s)

  • We’ll work with you on a suitable solution (replacement or credit)

We do not offer refunds for:

  • Customer errors in order or shipping info

  • Plants left in the package outside at customer’s delivery address where plants would bake in the hot sun or freeze from the outside climate

6. Intellectual Property

All content on this website—including images, graphics, logos, product descriptions, and text—is the property of Save Mangroves Nursery and protected under copyright and trademark laws.

You may not:

  • Reproduce, copy, modify, or republish any content

  • Use our logo or branding without written consent

  • Resell or redistribute our product photos or listings

7. User Conduct

You agree not to use the Site to:

  • Post or transmit unlawful, harassing, or abusive content

  • Attempt to hack, disrupt, or misuse the Site

  • Impersonate any person or entity

  • Collect data from the Site without consent

Violations may result in termination of access and legal action.

8. Disclaimer of Warranties

All products and services are provided “as-is” and “as available” without warranties of any kind, either express or implied. We do not guarantee:

  • That our plants will thrive in all conditions

  • That the Site will be error-free or uninterrupted

  • That any defects will be corrected

Proper aquarium care, lighting, and water quality are the buyer’s responsibility.

9. Limitation of Liability

To the fullest extent permitted by law, Save Mangroves Nursery shall not be liable for:

  • Any indirect, incidental, or consequential damages

  • Loss of data, revenue, or profits arising from your use of the Site or our products

  • Issues beyond our control, including shipping delays or weather-related plant damage

Our total liability, if any, shall not exceed the total amount paid for the product(s) in question.

10. Indemnification

You agree to indemnify and hold harmless Save Mangroves Nursery, its owners, affiliates, and employees from any claims, damages, liabilities, or expenses arising out of:

  • Your misuse of the Site or products

  • Your breach of these Terms

  • Your violation of any applicable law or third-party rights

11. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of Hawaii, without regard to conflict of laws principles.

Any disputes will be handled exclusively in the courts of the State of Hawaii.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will take effect upon posting to this page. Your continued use of the Site following any changes constitutes acceptance of those changes.
